GENDER ISSUES IN PHILOSOPHY OF LAW AND LEGAL REASONING

Interdisciplinary research on the intersection between Gender Studies and Law has been enjoying increased attention from Scholars. Recent developments in Gender Studies, arising especially from the areas of Queer and Feminist Theories, have led to the proposal of new paradigms for the analysis of the various aspects of normativity – with important consequences for all areas of practical philosphy, including Philosophy of Law. A gender approach to Legal Theory and Methodology, as well as to Philosophy of Law, demands a thorough reflection not only on the subjects chosen for investigation, but also on the way these fields have been developing, especially with respect to the employed methodology. An understanding of Law that critically questions the foundations of its own structure, and therefore does not postulate man as being the sole measure for all things, plays an essential part in the task of achieving social, political and economic gender equality.
Considering the interdisciplinary nature of the topic, this workshop shall address the various epistemic-theoretical, ethical and methodological concerns arising from a gender approach to Philosophy of Law and Legal Reasoning. The workshop aims at clarifying questions such as the following:
How do issues arising from the field of Gender Studies contribute to the development of Legal Theory and Philosophy of Law?
What are the implications of a transversal gender perspective upon the law?
What are the implications of Feminist Ethics on the moral dimension of law (e.g., Natural Law Theory, Human Rights, Non-Positivism, Radbruchs’ Formula)
How does a gender perspective on Legal Theory challenge universalist and objectivist Theories?
How do gender issues reflect on Legal Methodology?
The Workshop invites contributions that approach these and related questions from various perspectives, especially Legal Theory, Philosophy of Law and Gender Studies.
Registration of proposals:
All interested applicants are invited to send an abstract (max. 300 words) and a brief academic CV (under 100 words) to jessica.holl@uni-erfurt.de and fill out the registration form provided in the IVR 2022 website until May, 25th 2022.
A confirmation of approval will be sent until May, 30 2022.
The workshop will be held in English.
